Pimentel questions need for SOGIE bill
This apart, the bill aims to take steps to promote affordable housing for everyone. In India, this regulatory bill was presented in the Parliament inafter which it underwent numerous amendments.
The bill was finally passed by the cabinet after five years, on June 4, When the Real Estate Bill comes into effect, home or property buyers can expect to get timely ownership, and as per the promises made by developers.
The real estate sector in India is infamous for being unregulated and unorganized, with no proper guidelines for builders to follow, because of which buyers are routinely taken on a ride. Over the last decade, real estate prices have gone up so much that a common man now will find it very hard to buy a home of his own.
In such a scenario, regulation is the need of the hour. And, one hopes this new bill will rise to the occasion. However, when the bill becomes an act, it will be applicable only to new real estate projects and not ongoing or completed projects. It proposes to get real estate companies registered with the proposed regulator if the project is being developed in more than meters of land. Developers or builders will have to submit detailed project reports that will include:.
In addition, the bill seeks to enforce strict penalties for various offences. All said, the real estate bill promises complete justice, by ensuring buyers get their dream homes on time and at an affordable price. Developers or builders will have to submit detailed project reports that will include: completion date land title names of architects and agents details of the bank account where the amount generated from project sales will be deposited. This amount will not be used for other activities In addition, the bill seeks to enforce strict penalties for various offences.
Advantages of the bill: Timely delivery of flats: Developers often make false promises about the completion date of the project, but hardly ever deliver. As per the bill, strict regulations will be enforced on builders to ensure that construction runs on time and flats are delivered on schedule to the buyer.
Furnishing of accurate project details: In the construction stage, builders promote their projects defining the various amenities and features that will be part of the project.
But not everything goes as per plan, with several features missing. As per this bill, there can't be any changes to a plan. But, not all buyers are aware of the concept of carpet area.
With this bill it will become mandatory to declare the actual carpet area. All clearances are mandatory before beginning a project: Builders often attract buyers with huge discounts and pre-launch offers.
And, the buyer, enticed by the offers, does not bother about the clearance. But, due to delays in getting clearance, the buyer does not get the flat on time. This bill ensures that developers get all the clearances before selling flats. Each project should have a separate bank account: Developers raise funds through pre-launch offers and use them to purchase some other land or invest it in other projects.
This bill will make it compulsory that a separate bank account be maintained for each project. Each transaction will have to be recorded, and diversion to another project will not be entertained. After sales service: As per an interesting clause in the bill, if the buyer finds any structural deficiency in the development of the building, the buyer can contact the builder for after sales service.
But, the buyer should approach the builder within a year of purchase to rectify such defects without further charges. Disadvantages of the bill: Past real estate projects not included in the bill: Only new projects are covered by the bill. Hence, many buyers will not be benefitted by it. Delay from government agencies: There can be delays caused by the government, which sometimes takes a lot of time to clear a project.Pimentel raised the question at the hearing of the Senate committee on women, children, family relations and gender equality on Tuesday.
The senator said that some discriminatory acts may be covered by Republic Act No. Kasi marami nang nagsasabi na ang pakiramdam, punishable na rin naman sila ngayon by set of laws," Pimentel said during the hearing. What we really need to answer is, how can the SOGIE bill help to remove or address the experiences of discrimination that were shared? Because some said that it feels like these are punishable by existing set of laws. Klaruhin natin 'yan. Let's clarify that. Galfo said that she went to the Department of Labor and Employment to file a complaint but nothing happened.
All versions of the bill have provisions for imprisonment as part of the penalties. Pimentel suggested that the criminal provisions of the measure be taken out. Apparently, there are still gaps in the existing laws," Hontiveros said. Hontiveros also said that she doesn't want the measure to be used to merely file cases against perpetrators, but to prevent discrimination against the community.
It has to be very clear, that even if it doesn't lead to an administrative or criminal case, every one will recognize gay rights as human rights," Marcos said. In the 17th Congress, the House of Representatives passed the SOGIE bill on third and final reading but its counterpart measure languished in the Senate and did not even make it past second reading.

Villanueva said that out of the 13 versions of the SOGIE equality bill in the House, 10 would require parents to secure a family court order should they want their children to undergo any medical or psychological examination in matters related to SOGIE.
Religious speeches would be exempt from penalties, but the JIL founder said there is a loophole in the bill. Villanueva delivered his privilege speech two weeks after transgender woman Gretchen Diez was barred by janitress Chayra Ganal from using a women's restroom at Farmers Plaza in Cubao, Quezon City, and was later arrested for it.
The incident renewed calls for the passage of the SOGIE equality bill, which was approved in the House of Representatives in the previous 17th Congress but languished in the Senate.
Villanueva believes Diez's ordeal became a "full-blown tug-of-war" that supposedly disregarded Ganal's side of the story. Ganal and Farmers Plaza have since apologized to Diez. Villanueva, who is also a House deputy speaker, did not allow any lawmaker to interpellate him after his speech.

The Sexual Orientation and Gender Identity and Expression Equality bill, also known as SOGIEis designed to protect the queer and transgender individuals living in the Philippines by ordering establishments to provide gender neutral bathrooms, setting up special protection desks for LGBTQ people in police stations and penalizing discrimination via fines or even jail time.
For those initially on the fence about the bill, which passed after a third read-through and bears similarities to another bill from that passed through the House of Representatives but stalled in the Senate, it appears that leveling the playing field for all citizens of the Philippines was a deciding factor.
The bill still needs to pass through the Senate and then get approval from President Rodrigo Duterte. The latter step may prove more challenging- President Duterte has a poor track record when it comes to human rights, to put it mildly. But no matter how difficult the path ahead, the unanimous approval of this anti-LGBTQ discrimination bill is a step in the right direction. Katie Way. Related Tags Politics.
